These terms govern the tutoring services provided by Clearmark Tutoring. By booking a session, you agree to be bound by these terms.

1. Definitions

In these Terms & Conditions, the following definitions apply:

  • “We”, “us”, “our” means Clearmark Tutoring Ltd (company number 17234360), trading as Clearmark Tutoring.
  • “You”, “your” means the parent, carer, or guardian who enters into this agreement and is responsible for payment.
  • Student means the child or young person receiving tutoring services.
  • Session means a tutoring lesson of the agreed duration (typically 60 minutes unless otherwise stated).
  • Tutor means the individual delivering the tutoring session on behalf of Clearmark Tutoring.

2. Our services

2.1 Clearmark Tutoring provides specialist English tutoring services for students in Key Stage 3 (Years 7–9), GCSE (Years 10–11), and A-Level. Sessions are available on a 1-to-1 basis, in small groups, and as intensive boot camps.

2.2 Sessions are delivered online via video conferencing, and in person at an agreed location (from September 2027 onwards, subject to availability).

2.3 At the outset of the tutoring relationship, we will carry out an initial diagnostic assessment and create a personalised learning plan for the student. This plan will be shared with you and reviewed regularly.

2.4 We will provide half-termly written progress reports. These are included in the cost of tutoring and are not charged separately.

3. Booking and enrolment

3.1 All new students begin with a free 20-minute consultation. This is an opportunity for us to understand the student’s needs and for you to decide whether our service is the right fit. The consultation does not commit you to booking sessions.

3.2 Following the consultation, if you wish to proceed, you will be asked to complete an enrolment form providing the student’s details, any relevant medical or SEND information, emergency contacts, and consent for session recording (for safeguarding purposes).

3.3 Sessions are booked on a weekly recurring basis or as block bookings (5 or 10 sessions). The agreed day and time will be confirmed at enrolment. Changes to the regular slot are subject to availability.

3.4 By completing the enrolment form and making your first payment, you confirm that you have read, understood, and agree to these Terms & Conditions, our Safeguarding Policy, and our Privacy Policy.

4. Pricing and payment

4.1 Our current pricing is published on our website. Prices are quoted per session and inclusive of all preparation, marking, and progress reporting.

4.2 Block booking discounts are available as follows:

  • Block of 5 sessions: 5% discount on the standard per-session rate.
  • Block of 10 sessions: approximately 8% discount on the standard per-session rate.

4.3 Block bookings are paid in advance and are non-refundable except as described in clause 7 (Cancellations and Refunds). Block sessions do not expire but must be used within 6 months of purchase.

4.4 For in-person sessions (from September 2027), a travel premium of £5–£10 per session may apply for locations beyond 5 miles from the tutor’s base. This will be confirmed before booking.

4.5 Payment is due in advance of each session, or in advance of the block. We accept payment by bank transfer, Stripe, or GoCardless. Payment must be received before the session takes place. We do not accept cash.

4.6 If payment is not received within 7 days of the due date, we reserve the right to suspend sessions until the balance is cleared. We will contact you by email or phone before taking this step.

4.7 We reserve the right to review and adjust our pricing annually. You will be given at least 30 days’ written notice of any price change. Existing block bookings will be honoured at the price at which they were purchased.

5. Session conduct

5.1 Students are expected to attend sessions on time, with any required materials, and ready to learn. Persistent lateness or lack of engagement may be raised with you as the parent/carer.

5.2 We maintain a supportive and respectful learning environment. Abusive, threatening, or discriminatory behaviour by any party (student, parent, or tutor) will not be tolerated. We reserve the right to terminate the tutoring relationship immediately in such circumstances, without refund for unused sessions.

5.3 For online sessions, students must have access to a reliable internet connection, a device with a camera and microphone, and a quiet, appropriate space to work. We are not responsible for technical issues on the student’s end, but we will make reasonable efforts to reschedule if a session is disrupted by technology.

5.4 For online sessions, a parent/carer should be within earshot wherever reasonably practicable, and must be present or within immediate earshot for students under 13. This is a safeguarding requirement.

5.5 Tutors will not provide personal contact details to students. All communication must go through official Clearmark Tutoring channels.

6. Your responsibilities as parent / carer

6.1 You are responsible for providing accurate and up-to-date information about your child, including any medical conditions, SEND, allergies, or safeguarding concerns that may affect the tutoring relationship.

6.2 You must inform us promptly of any changes to your child’s circumstances, including changes to their school, EHCP, or any involvement with children’s services.

6.3 You are responsible for ensuring your child attends sessions and has appropriate equipment and materials.

6.4 You must inform us if your child is unwell or unable to attend a session, in accordance with the cancellation policy below.

7. Cancellations and refunds

7.1 Cancellation by you (parent / carer)

  • More than 24 hours’ notice: The session will be rescheduled at a mutually convenient time within 14 days. No charge.
  • Less than 24 hours’ notice: The full session fee is payable. We may, at our discretion, offer a reschedule for genuine emergencies (e.g. illness requiring medical attention), but this is not guaranteed.
  • No-show (no notice): The full session fee is payable. No reschedule will be offered.

7.2 Cancellation by us

If we need to cancel a session (e.g. tutor illness), we will offer a reschedule at a mutually convenient time at no additional cost. If a reschedule is not possible, a full refund for that session will be issued within 14 days.

7.3 Ending the tutoring relationship

Either party may end the tutoring relationship by giving 14 days’ written notice. On termination:

  • Any unused sessions from a block booking will be refunded on a pro-rata basis, minus any discount that was applied (i.e. the refund will be calculated at the standard per-session rate, not the discounted block rate).
  • Any outstanding fees must be paid within 14 days of termination.
  • We will provide a final progress report summarising the student’s achievements and areas for further development.

7.4 First-session guarantee

If you are not satisfied after the first paid session, we will refund the full session fee, no questions asked. This guarantee applies to the first session only and must be claimed within 48 hours of the session.

8. Intellectual property

8.1 All teaching materials, learning plans, revision resources, and content created by Clearmark Tutoring remain our intellectual property. You may use these materials for the student’s personal educational use only.

8.2 Materials must not be copied, shared, distributed, uploaded to the internet, or used for any commercial purpose without our prior written consent.

9. Limitation of liability

9.1 Clearmark Tutoring provides tutoring services with reasonable care and skill. However, we do not guarantee specific academic outcomes, grades, or examination results. Academic performance depends on many factors beyond our control, including the student’s effort, school teaching, attendance, and home support.

9.2 Our total liability to you in connection with the services shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.

9.3 Nothing in these Terms & Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter for which it would be unlawful for us to exclude or limit liability.

9.4 We hold professional indemnity insurance and public liability insurance. Details are available on request.

10. Data protection

10.1 We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details are set out in our Privacy Policy, which is available on our website and provided at enrolment.

10.2 By enrolling your child, you consent to our collection and processing of personal data as described in the Privacy Policy. You have the right to withdraw consent and to request access to, correction of, or deletion of your child’s data at any time.

11. Safeguarding

11.1 Clearmark Tutoring is committed to safeguarding and promoting the welfare of all children. Our full Safeguarding & Child Protection Policy is available on our website and provided at enrolment.

11.2 All tutors hold an Enhanced DBS certificate checked against the children’s barred list. Copies are available for inspection on request.

11.3 If we have any safeguarding concerns about a student, we are legally and morally obliged to share information with the relevant authorities (e.g. local authority children’s services, police). We will not be able to inform you in advance if doing so could put the child at further risk.

12. Complaints procedure

12.1 We take all complaints seriously and aim to resolve them promptly and fairly.

12.2 If you have a complaint, please follow these steps:

  • Step 1 — Informal resolution: Raise the concern with your tutor or with Connor O’Donnell (Business Operations) by email or phone. We will aim to resolve the matter within 5 working days.
  • Step 2 — Formal complaint: If you are not satisfied with the informal resolution, submit a written complaint to info@clearmarktutoring.co.uk. We will acknowledge receipt within 2 working days and provide a full written response within 15 working days.
  • Step 3 — External resolution: If you remain dissatisfied, you may contact the relevant professional body or the Citizens Advice Bureau. If your complaint relates to a safeguarding matter, you may contact the LADO (see our Safeguarding Policy for contact details).

13. Force majeure

We shall not be liable for any failure or delay in providing services caused by events beyond our reasonable control, including but not limited to pandemic, epidemic, severe weather, power failure, internet outage, government restrictions, or industrial action. We will use reasonable endeavours to reschedule any affected sessions.

14. General provisions

14.1 These Terms & Conditions, together with the Safeguarding Policy and Privacy Policy, constitute the entire agreement between you and Clearmark Tutoring in relation to the tutoring services.

14.2 We may update these Terms & Conditions from time to time. You will be given at least 30 days’ notice of any material changes. Continued use of our services after the effective date of the updated terms constitutes acceptance.

14.3 If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.4 These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.5 Clearmark Tutoring is a trading name of Clearmark Tutoring Ltd, registered in England and Wales (company number 17234360).
